Legal Misunderstandings Of THCA: Impacts On Smoke Shops And Law Enforcement

THCA, or tetrahydrocannabinolic acid, is a naturally occurring cannabinoid that can be found in large quantities in raw cannabis buds. When consumed unprocessed, THCA does not cause psychosis while THC is the psychoactive type of the compound that generates from heating THCA through a process known as decarboxylation. This distinction between THCA and THC is vital for understanding the recent legal challenges faced by smoke shops.

Recent incidents have highlighted a major issue; when law enforcement tests burned or even heated THCA products, the results often incorrectly identify them as containing THC, leading to legal complications. This problem emerged prominently in a recent investigation involving several smoke shops that possess THCA products.

The Misunderstanding of THCA in Legal Disputes

The CMPD crime lab’s tests, conducted using gas chromatography, revealed high THC levels in the tested samples. However, this test inadvertently created THC from the THCA, thus falsely indicating that the samples contained illegal substances.

 As legal expert Kight pointed out, “What the lab did that tested this particular sample is it actually created illegal marijuana from legal hemp,”

However, there was an undercover operation that was initiated in March and targeted various smoke shops, but samples were only sent for lab testing in late May. Although seven smoke shops were raided,  on the other hand, the same brands sold at these locations—such as Zaza, High Life, Torch, Venera, Cookies, Better Dispensary, and Galaxy Monkey—are also available at 26 other smoke shops located in Statesville.

The issue is compounded by the fact that any THCA product subjected to gas chromatography testing will convert THCA to THC, irrespective of any brand name linked to it. The confiscated products included large quantities, but interestingly, these amounts were not detailed in the evidence photographs, raising concerns about the integrity of the investigation.

Moreover, the lab results showed THC levels up to five times higher than the legal threshold of 0.3%. This anomaly is partly due to the nature of the test and environmental factors such as the duration the product remains on the shelf. The longer THCA is exposed, the higher the potential THC content.
